Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Workifya’s website, mobile applications, and related services (collectively, the "Services"). “Workifya,” “we,” “us,” and “our” refer to Workifya.
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Definitions
- Customer: a user who posts a job request or seeks services.
- Worker: a user who offers services and responds to jobs.
- Job: a service request posted by a Customer.
- Content: text, photos, messages, attachments, listings, and other materials submitted to the Services.
- Credits: prepaid units or balances that may be used for certain paid features (as described in the Services).
2. What Workifya Is (and Is Not)
Workifya is a platform that helps Customers and Workers discover each other and communicate. Workifya does not provide the services offered by Workers and does not employ Workers.
You understand and agree that:
- Any agreement for services is between the Customer and the Worker. Workifya is not a party to that agreement.
- Workers are independent third parties and are solely responsible for their services, pricing, tools, licenses, permits, insurance, and compliance with laws.
- Workifya does not guarantee that a Worker will respond, that a Job will be completed, or that the outcome will meet expectations.
3. Eligibility and Accounts
- You must be at least 18 years old (or the minimum age required by law where you live) to use the Services.
- You agree to provide accurate information and keep your account information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
- We may refuse, suspend, or terminate accounts as permitted by these Terms.
4. User Content and Messaging
4.1 Your Responsibilities
You are responsible for your Content and communications on the Services, including:
- Job descriptions, pricing, requirements, and instructions
- Messages between Customers and Workers
- Photos, attachments, and profile information
4.2 Content License
You grant Workifya a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute your Content solely to operate, improve, and provide the Services (including showing Content to other users as intended).
4.3 Content Rules
You agree not to post or send Content that:
- Is illegal, fraudulent, misleading, defamatory, harassing, hateful, or otherwise harmful
- Infringes intellectual property or privacy rights
- Contains malware, malicious code, or attempts to compromise the Services
- Includes sensitive personal data of others without permission (e.g., government IDs, financial account numbers)
5. Marketplace Rules
5.1 Jobs, Quotes, and Agreements
- Customers are responsible for clearly describing Jobs and selecting Workers.
- Workers are responsible for evaluating Jobs, providing quotes, and delivering services safely and professionally.
- Workifya may provide tools to facilitate communication, but does not control or supervise offline interactions or job performance.
5.2 Safety and Due Diligence
Users should use common sense and take precautions when meeting in person, sharing addresses, allowing entry to homes, and exchanging payments. Workifya does not run background checks unless explicitly stated in the Services.
6. Fees, Credits, Subscriptions, and Payments
6.1 Paid Features
Some parts of the Services may require payment, subscriptions, or Credits. Pricing, included features, and billing intervals will be disclosed in the Services at the time of purchase.
6.2 Credits
- Credits have no cash value and are not legal tender.
- Credits are non-transferable unless we explicitly allow transfers in the Services.
- We may offer promotional/free Credits subject to additional rules shown in the Services.
- Except where required by law, Credits are non-refundable.
6.3 Payment Processing
Payments may be processed by third-party payment processors (e.g., Stripe). Your use of payment services is subject to the processor’s terms and privacy policy. Workifya does not store full payment card details.
6.4 Taxes
You are responsible for any taxes that apply to your purchases or earnings, unless required otherwise by law. Workers are responsible for reporting income and complying with tax obligations.
7. Cancellations, Refunds, and Chargebacks
- Subscription cancellation takes effect as described in the Services (e.g., end of the billing period), unless local law requires otherwise.
- Refunds (if any) are governed by the policy displayed at purchase and applicable law.
- We may suspend accounts associated with suspected fraud, abuse, or excessive chargebacks.
8. Prohibited Conduct
You agree not to:
- Use the Services for illegal purposes or to violate any laws
- Harass, threaten, stalk, or discriminate against others
- Scrape, crawl, reverse engineer, or attempt to extract source code except as permitted by law
- Bypass or interfere with security, rate limits, access controls, or authentication
- Post false Jobs, impersonate others, or misrepresent affiliations
- Send spam, unsolicited promotions, or misleading communications
- Upload viruses or harmful code
9. Intellectual Property
The Services, including our software, design, logos, and trademarks, are owned by Workifya or our licensors and are protected by law. Except for the limited rights needed to use the Services, we grant you no other rights or licenses.
10. Third-Party Services and Links
The Services may integrate or link to third-party services (e.g., maps, payments, analytics). We are not responsible for third-party content, policies, or practices. Your use of third-party services may be subject to their separate terms.
11. Suspension and Termination
We may suspend or terminate your access to the Services at any time if we believe you violated these Terms, pose a risk to others, or if required by law. You may stop using the Services at any time.
Sections that by their nature should survive termination will survive, including (but not limited to) Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, and Dispute Resolution.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Workifya disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Workifya does not warrant that the Services will be uninterrupted, error-free, secure, or that any defects will be corrected. Workifya does not guarantee the quality, safety, legality, or suitability of any services performed by Workers.
13. Limitation of Liability
To the maximum extent permitted by law, Workifya and its affiliates, officers, directors, employees, and agents will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, goodwill, data, or business opportunities
- Personal injury, property damage, or disputes arising from interactions between Customers and Workers
To the maximum extent permitted by law, Workifya’s total liability for any claim arising out of or relating to the Services will not exceed the greater of: (a) the amount you paid to Workifya for the Services in the [3] months before the event giving rise to the claim, or (b) CAD $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnity
You agree to indemnify, defend, and hold harmless Workifya and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Services
- Your Content or your interactions with other users
- Your violation of these Terms or applicable laws
15. Dispute Resolution
15.1 Informal Resolution
Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally. You can reach us at support@workifya.com.
15.2 Governing Law and Venue
These Terms are governed by the laws of [Province/State, Country], without regard to conflict of law principles. Any dispute not resolved informally will be brought in the courts located in [City, Province/State], unless applicable law requires otherwise.
Optional note: If you want arbitration/class-action waiver language, tell me your target jurisdictions (Canada-only vs US/EU), because those clauses must be tailored carefully.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date and, where required, provide notice through the Services. Your continued use of the Services after the effective date means you accept the updated Terms.
